In processing personal data, samsam.co.za exercises the utmost care. Transparency is an essential part of this diligence. samsam.co.za believes it is important for third parties and data subjects to have insight into how it uses personal data and the reasons behind it. Therefore, it has prepared this statement. If, after reading this statement, you have any questions or comments, you can contact samsam.co.za. This also applies if you wish to exercise any of the rights described below or if you have a complaint. The complete address and contact person’s name can be found at the bottom of this statement.

Does samsam.co.za have a Data Protection Officer?

Samsam.co.za has not appointed a Data Protection Officer. However, it has designated an employee as the primary point of contact for privacy and personal data matters. This employee is Mr. J.D. Kleppe. The full address can be found at the bottom of this statement.

What personal data does samsam.co.za process, and why does it do so?

Samsam.co.za processes various types of personal data for various reasons. The most processed data types include:

  • Identification data (name, email address, contact person, telephone number, registration number)
  • Location data (postal and/or business address)
  • Financial data (bank account number, payment details).

When processing job applications, samsam.co.za also processes additional data, namely:

  • Family composition, education, and training

When you visit samsam.co.za’s website, it may process additional data not mentioned above. This could include:

  • Information about the device, location, software usage, and similar data.

The primary purposes of this processing are to establish a contract with the customer, as effective communication between samsam.co.za and the customer is essential. This includes activities such as assessing customer preferences and preparing quotations.
The secondary purpose is to execute the established contract, which includes regular discussions about progress.

The tertiary purpose is to enable billing for services or facilitation of payment (and, if necessary, collection).

The fourth purpose is to conduct marketing activities aimed at acquiring more customers or increasing brand awareness.

The final purpose is to inform the customer about developments that may be relevant to them.

Is samsam.co.za allowed to process this data?

Samsam.co.za processes personal data when necessary to establish or execute a contract with a customer and/or supplier. This is the case when a quotation is requested, an order is placed, or when samsam.co.za places an order itself. Additionally, samsam.co.za processes personal data when its legitimate interests justify it. This would be the case when it is reasonably impossible for samsam.co.za to carry out its activities without processing such data. Lastly, in some cases, samsam.co.za may request consent to use the data. The legal basis(es) for processing are, therefore:

  1. Processing is necessary for the performance of a contract to which the data subject is a party, or in order to take steps at the request of the data subject prior to entering into a contract.
  2. Processing is necessary for the purposes of the legitimate interests pursued by samsam.co.za (or a third party).
  3. The data subject has given consent to the processing.

Regarding category (2), it should be noted that in all cases, these are processing activities necessary for samsam.co.za to carry out its services. Samsam.co.za cannot perform its activities, communicate, issue quotations, etc., without using the personal data of the customer. Therefore, samsam.co.za believes that, when balanced against the interests of the data subject, its legitimate interest should take precedence. Two considerations are crucial here. First, samsam.co.za knows from experience that such processing activities generally do not raise objections. Second, samsam.co.za does not retain data longer than necessary. However, to respect the rights of the data subject as much as possible, samsam.co.za only uses the data necessary to achieve the purpose.
Regarding category (3), consent can be withdrawn at any time, without stating a reason.

Do these personal data also reach others?

In some cases, samsam.co.za may share personal data with parties it collaborates with, known as ‘processors.’ Samsam.co.za has agreements with these processors to ensure they handle data with the same care as samsam.co.za. These agreements require, among other things, proper security measures, confidential treatment of data, and data destruction.
Samsam.co.za does not intend to share personal data with parties other than processors. At most, it anticipates that, in specific cases, information may be shared with (another) employee of the customer or with parties in a direct relationship with the customer.

How long are the data retained?

Samsam.co.za retains the data it collects for various periods, depending on the data category and how it was collected. The precise periods are outlined in the data processing register prepared by samsam.co.za.
When determining the applicable periods, samsam.co.za primarily considers legal (minimum) terms. This includes legal obligations to retain accounting information. Additionally, samsam.co.za has sought to align with retention periods outlined in the Dutch Personal Data Protection Act (Vrijstellingsbesluit Wbp) where possible. For instance, regarding customer contact details, there is a retention period of up to one year after the termination of the relationship between the parties. Lastly, samsam.co.za has set retention periods based on its own interests and those of its customers. For example, both parties may find it important for documents containing (additional) agreements to be retained for more than two years. If such documents (e.g., email correspondence) contain personal data, they are also retained.

Regarding data collected through cookies on the website, the retention periods are as described in the Cookie Statement (found elsewhere on this website).
