1. What is the processing of personal data?

Processing is anything that can be done with personal data. For example, collecting, storing, retrieving, using, associating, and deleting data from our records. This is a very broad concept. Personal data includes all information that directly or indirectly reveals something about a natural person. For example, name and address, but also – in combination with them – consumption data.

2. Who is responsible for the processing of my personal data?

3. Whose personal data do we process?

We process data of individuals with whom we have, want to establish, or have had a customer relationship. These include personal data of:
• (Former) customers
• Individuals showing interest in our products and services
• Individuals associated with a company or organization with whom we have, want to establish, or have had a customer relationship. If a company or organization has a customer relationship with us and provides us with contact details of its employees, that company or organization is obliged to inform these individuals about this. In this privacy statement, these individuals can see how we handle their personal data. We may also process personal data of third parties with whom we do not have or have had a customer relationship, for example, if you rent a house including energy.

4. What personal data do we process?

We have personal data if you have provided it to us or if you use our services and/or products. We may also have access to this data by consulting public sources and/or by enriching data through third parties.

The personal data we process are:

  • Gender
  • Date of birth
  • Contract details
  • Communication (emails, voicelogs, chat)
  • IBAN bank account number

  • (Smart) metering, charging, and consumption data

We retain personal data according to our internal retention policy and/or as long as (i) you are a customer or continue to show interest in our services, (ii) we are legally required to retain data, or (iii) we have reasonable grounds to retain data as necessary.

5. For what purposes does samsam.co.za process personal data?

a. Execution of the agreement between you and samsam.co.za

If you want to become our customer or if you want to purchase a new product or service, we need personal data. We cannot provide services without using your data for this purpose. For example, we use your name and (email) address for our administration and to stay in touch with you. We also use your personal data to answer your questions and handle complaints and disputes, even after the agreement has ended. We record conversations, such as phone calls and chat sessions with us. This also applies to the questions you ask us by email, mail, app, chat, or phone. We do this, among other things, for training purposes (legitimate interest) and to review our agreements with you later and for (legal) evidence purposes. But we also need your data, for example, to technically enable our services.

b. To enter into and execute agreements with suppliers and business customers

If you have contact with us for work purposes, we may process your personal data. For example, to determine if you are authorized to represent the company. Or to maintain contact with the company you work for.

d. To request consent for the processing of certain personal data

For example, to inform you about (new) relevant products and services from other group companies of samsam.co.za and/or activities and promotions that samsam.co.za organizes in collaboration with its carefully selected partners. If you have a smart meter, we ask for your consent to retrieve your meter readings from your network operator daily. The network operator reads the meter readings and provides them to us on a daily, hourly, and quarter-hour basis. For example, if you want to use our consumption and insight services, which provide you with insights into your energy consumption and costs. If you give consent for this, you can withdraw it at any time. This can be done by contacting our Customer Service. The withdrawal of your consent cannot be retroactive.

e. To further develop and improve our products and services

To serve you well and continuously, we are constantly working on the development and improvement of our products and services. In some cases, we process personal data for this purpose. We do this, among other things, for quality purposes. For example, when you ask a question about a product.

f. To improve our business operations

We process your data to provide management information and determine our general strategy and organizational policy.

g. To carry out our promotional and marketing activities

We also use your personal data for promotional and/or marketing purposes. For example, to inform you about (new) relevant products and services and/or activities. We do this via email, app, phone, or mail. If you do not wish to receive this information, you can unsubscribe through the unsubscribe option provided in these messages or contact our customer service.

If you are no longer a customer, we may still approach you with an offer to become a customer again unless you have unsubscribed from this. samsam.co.za has a maximum term of two years after the end of the customer relationship for this.

When you visit our website, we may link your use of our website to the information we have about you to improve our service to you and to display relevant advertisements. We may also use the data to conduct analyses to provide you with more targeted information on the websites. We explain this further in our cookie statement, which you can find on our website.

6. To whom do we disclose your personal data?

We engage third parties to support daily business operations, such as server storage, communication, websites, financial, and legal services. We also share your personal data with third parties to fulfill your agreement, such as your network operator, for the issuance and reading of consumption data from your charging card or the installation of your charging solution.

As far as we share personal data with third parties, and the law requires us to enter into a data processing agreement, we stipulate in that agreement that those parties are bound by the law and the same strict data protection requirements that we use for our own processing.

7. What are my rights?

You have several rights when it comes to processing your personal data. There are always exceptions to these rights, which may prevent us from fulfilling your request. If that is the case, we will explain it to you. You have the following rights:

  • Right to access your personal data
  • Right to rectify your personal data
  • Right to erasure (“right to be forgotten”)
  • Right to object to the use of your personal data
  • Right to limit the use of your personal data

8. Are my personal data secured at samsam.co.za?

Your personal data is carefully stored. We do not keep it longer than necessary for the purpose for which we process the data. Within samsam.co.za, your personal data can only be used by employees who need it for their job. If we want to use data for a purpose other than the one originally processed, we can only do so if there is a close connection between the two purposes. Your personal data can also be exchanged between the divisions of ServiceHouse B.V., but only if there is a legal basis for this and if it is compatible with the purpose for which the data was collected.
